Age Gating & Third-Party Verification

All brick-and-mortar retailers must require that their employees verify valid government-issued photo IDs as required by law for sales of product. For age verification materials and apps, please refer to the We Card, state, local, and FDA sections of this reference guide. Online retailers are required to use independent, robust third-party age verification systems to verify that tobacco product consumers are at least 21 years of age. We recommend that online retailers use a two- step process of both age gating (prior to entry to the website) and age verification (prior to purchase). While we cannot recommend or endorse a specific age verification system, the following companies are representative of this kind of service:

Bulk Ordering Restrictions

We recommend that any online retailer limit bulk orders to prevent youth, or those supplying youth, from buying in large quantities to resell product. While a retailer must determine the appropriate bulk ordering restrictions for its business, here is an illustrative example:

  • B2C transactions to 60 pods per month
  • B2C transactions to 60 disposable vapes per month
  • B2C transactions to 4 devices per month
  • B2C transactions to 15 bottles per month

"We Card" Non-Profit

The We Card Program, Inc. is a national non-profit organization serving the nation's retailers of tobacco, alcohol, e-cigarettes, vapor products and other age-restricted products. Individual retail establishments as well as large retail chains utilize We Card's educational and training services for their compliance efforts with federal, state and local laws on preventing age-restricted product sales to minors.

Signature on Delivery

Certain states require tobacco products purchased on-line by a consumer to be shipped requiring signature on delivery. Check the laws of the states to which you ship to see if they require your products be shipped signature on delivery. With the recent amendment of the PACT Act (federal law), all shipments will require signature on delivery. Please stay informed of these developments so that you can be ready to ship your products requiring signature on delivery once it is required in all 50 states.
