If you’re a part of the vaping business, you’ve probably heard about the skyrocketing popularity of non-tobacco nicotine. Also known as synthetic nicotine, this type of nicotine isn’t extracted from tobacco leaves. Rather, it is synthesized in a lab. This type of nicotine has proven successful from vape fans because of its refined taste and increased purity. However, recently the FDA has cracked down on NTN. This is because the FDA views its use in vape products as vape companies taking advantage of a legal loophole to sell products. The FDA also sees NTN as being promoted to underage customers. For these reasons, the FDA is now going after synthetic nicotine manufacturers. So let’s unpack this and dive into the specifics of the ongoing NTN legislation…

A Quick History of the PACT Act 

In 2009, the Prevent All Cigarette Trafficking Act (PACT, for short) was ratified. The legislation forbids USPS from shipping cigs and smokeless tobacco items directly to customers. Several years later, in 2020, the Preventing Online Sales of E-Cigarettes to Children Act was passed. In this bill, Electronic Nicotine Delivery Systems (ENDS) were added to the restricted products list. The result was that vapes and e-cigs were also removed from shipping circulation. 

Non Tobacco Nicotine & PACT

Until recently, the PACT banned items list did not include synthetic nicotine. However, as of April 14th, 2022, NTN products are now within the PACT Act’s scope. The FDA is going to crack down on synthetic products in a big way. The Food and Drug Administration has now required all NTN manufacturers to submit their products for review. If proposed synthetic nicotine products do not get approval, they will be subject to the shipping ban. The marketing of these products will also be banned accordingly. Given the FDA’s aggressive approach here, it is highly likely synthetic nicotine products will not be approved. All of this represents a big blow to vaping businesses and customers. Only time will show how this unfolds and whether any NTN products pass muster and are allowed to be shipped.
